Despite what many people may tell you, there
is no Common Law marriage in California. However, in the well
followed case of Marvin v. Marvin,
the Supreme Court of California ruled that there are rights of both repayment
for capital contributions as well as implied in fact contract
rights in respect to property ownership and future support, even
where the promises were only oral in nature.
These rights
also survive your life partner's death for up to one year!
If you lived with or cared for your
life partner and you contributed money during the relationship or were made care and support
promises, then you may have rights in their estate or real property.
