California Domestic
Partner Rights and Responsibilities Act of 2003 Takes Effect on
January 1, 2005
AB 205
The California Domestic Partner Rights and Responsibilities
Act of 2003, commonly known as AB 205, becomes effective on
January 1, 2005. AB 205 sweepingly extends to domestic partners
most of the same rights and obligations of spouses under
California law. It requires that “registered" domestic
partners shall have the same rights, protections, and benefits,
and shall be subject to the same responsibilities, obligations,
and duties under law, whether they derive from
statutes, administrative regulations, court rules, government
policies, common law, or any other provision or sources of law,
as are granted to and imposed upon spouses.” Essentially, AB
205 amends references to the term “spouse” in California law
to include “domestic partner.” Thus, wherever state law, as
it has been broadly defined in AB 205, provides rights or
protections to “spouses,” it now affords the same rights to
“domestic partners.”

The California State
Constitution and Family Code still state that marriage is only between a man and a
woman;
In CA, Same sex couples are not allowed to marry and,
therefore, can not receive the same State
and Federal benefits given to
legally married couples.
